Terms of Service

Eligibility and your account

These Terms of Service ("Terms") govern your access to and use of EarnWay (the "Service"), operated by SRIRUNGRUANG VISAHAKIJ COMPANY LIMITED ("we," "us," or "EarnWay"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

To use EarnWay you must be at least 16 years old (or the minimum age of digital consent in your country, whichever is higher), have the legal capacity to enter into a binding agreement, and not be barred from receiving the Service under applicable law.

You are responsible for:

• Providing accurate, current information when you register, and keeping it up to date
• Maintaining the confidentiality of your password and account credentials
• Notifying us promptly at support@earnway.shop if you discover unauthorized use of your account
• All activity that occurs under your account, whether or not you authorized it

Each individual may hold only one account. Operating multiple accounts to inflate referral commissions, claim duplicate rewards, or evade suspensions is grounds for forfeiture of balances and termination.

The Service

EarnWay provides:

• A suite of AI-powered creative tools (text, image, voice, and video generation; translation; transcription; and similar)
• An EW Points wallet you can recharge to use those tools
• An optional rewards program through which you can earn EW by completing tasks supplied by third-party partners
• A referral program through which you can earn commissions on EW spent by members you refer

We may add, change, or remove features at any time. We will give reasonable notice of material changes that affect paid features or account balances.

Fees, payments, and recharges

Many AI features cost EW per use. EW is recharged by purchasing a package on the Billing page. All prices are displayed in US dollars unless otherwise indicated. We process payments through Stripe and PayPal; your payment is subject to those providers' terms.

Refunds. Once EW is credited to your wallet, purchases are non-refundable except where required by law or where we decide to issue a goodwill refund at our sole discretion. EW that has already been spent on AI features cannot be refunded. If a transaction fails or you are charged in error, contact support within 30 days.

Currency and taxes. You are responsible for any applicable taxes, duties, or charges imposed by your local jurisdiction. Where we are required to collect tax (for example, VAT or GST), the tax will be added to your invoice and remitted to the relevant authority.

AI features and content

EarnWay's AI features are powered by third-party AI providers including OpenAI, ElevenLabs, HeyGen, and Google. When you submit a prompt, the prompt and any uploaded media are sent to the relevant provider for processing. The provider may temporarily process and store the input according to its own terms.

Accuracy. AI outputs are generated by automated systems. They may contain errors, inaccuracies, omissions, or fabrications. You are responsible for reviewing AI outputs before using them and should not rely on AI output for medical, legal, financial, or other advice that requires professional judgment.

Prohibited uses of AI features. You agree not to use EarnWay's AI features to generate:

• Content depicting child sexual abuse, sexual content involving minors, or content that sexualises individuals who appear to be minors
• Non-consensual intimate imagery or content of identifiable real people without their permission
• Content designed to harass, defame, stalk, or impersonate a specific real person
• Material that incites or facilitates violence, terrorism, or hatred against people based on protected characteristics
• Content used to deceive (deepfakes intended for fraud, fake reviews, election misinformation, and similar)
• Malware, exploit code, phishing pages, or instructions for committing crimes

Violations may result in immediate suspension and forfeiture of any unwithdrawn EW.

Your content

"Your Content" means prompts, files, generated outputs, and any other material you submit to or create through the Service.

Ownership. You retain whatever rights you have in your prompts and inputs. Ownership of AI-generated outputs is governed by the underlying AI provider's terms and applicable law. In most jurisdictions, AI outputs may not be copyrightable to the same extent as human-authored work; you should not assume you hold exclusive rights in an AI output simply because you generated it.

License you grant us. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display Your Content as needed to provide the Service to you, to send it to the relevant AI provider for processing, and to back up our systems. This license ends when you delete Your Content or close your account, except where retention is required by law or to enforce these Terms.

EarnWay Points (EW) and ART

EW (EarnWay Points) are an in-Service credit. The current conversion rate is published on the Billing page. EW has no monetary value outside the Service except where validly withdrawn according to the Withdrawals section. EW is not legal tender, is not a security or investment instrument, and is not insured by any government.

ART (Advertising Revenue Token) is a loyalty token awarded on certain recharges and rewards activity. ART can be used inside the Service per the rules published on the relevant Service page. ART is not withdrawable to cash.

We may adjust the conversion rate, package pricing, or feature costs at any time. Changes apply prospectively and do not retroactively affect EW already credited to your wallet.

Rewards program (rewarded tasks)

The rewards program allows you to earn EW by completing tasks supplied by third-party partners, including surveys, offerwalls, rewarded videos, and sign-ups. Participation is optional.

How rewards work:

• Each task lists the EW you will earn upon valid completion, after the partner's payout is converted to EW and any applicable country tier multiplier is applied.
• Partners report completions to us via a postback. We credit your EW wallet only after we receive the partner's confirmation.
• Partners may take up to 72 hours, occasionally longer, to confirm a completion. Some offers require third-party action (account verification, trial-period completion, and similar) and may take longer still.
• Partners may reverse a completion if they later determine it was invalid, fraudulent, or did not meet the offer's requirements. When a partner reverses a completion, we will deduct the corresponding EW from your balance. If your balance is insufficient, we may apply the deduction to future earnings.

Country tier multipliers. The EW you earn per task depends on the country tier we have assigned to your account, which reflects the rate that advertising partners pay us for completions from that country. Your tier is determined automatically based on your registration country and IP address. Tier assignments and multipliers are published on the rewards page and may be updated from time to time.

Daily caps. We may impose a daily limit on the EW you can earn from rewarded tasks, both to comply with partner policies and to detect abuse. The current cap is displayed on the rewards page.

Withdrawals

Once your withdrawable EW balance reaches the minimum withdrawal threshold published on the Withdrawal page, you may request a withdrawal to a supported payout method. Withdrawal requests are reviewed manually before payout.

• Verification — we may require you to verify your identity (typically by providing a government-issued ID and proof of address) before processing a withdrawal, particularly for larger amounts. This is to comply with anti-money-laundering and tax regulations.
• Hold period — newly earned EW from rewarded tasks is subject to a hold period (published on the Withdrawal page) during which it cannot be withdrawn. The hold period allows partner reversals to be processed.
• Fees — some withdrawal methods carry a processing fee, displayed before you confirm the withdrawal.
• Refusal — we may refuse, delay, or reverse a withdrawal if we reasonably suspect fraud, multiple accounts, breach of these Terms, partner reversal, or a legal requirement.
• Tax reporting — withdrawals may be taxable income in your jurisdiction. You are responsible for your own tax compliance and for providing any tax forms required by law.

Referral program

Members may invite others to join EarnWay through a personal referral link. When a member you referred recharges EW or completes qualifying actions, you may earn a commission as published on the Referral page.

• You may not refer yourself, your alternate accounts, or accounts you control.
• You may not use deceptive, spam, or harassing methods to acquire referrals. Misleading advertising claims, unauthorized email blasts, and similar tactics are prohibited.
• Referral commissions are credited to your EW balance only after the referred member completes the qualifying action. We may reverse commissions if the underlying recharge is refunded or if we determine the referral was fraudulent.
• We may adjust the referral commission rate or program rules at any time. Changes apply prospectively.

Prohibited conduct

You agree not to:

• Operate more than one account, share an account with others, or sell or transfer your account
• Use automation, scripts, bots, or third-party software to interact with the Service in ways not specifically permitted
• Use VPNs, proxies, emulators, or device-spoofing tools to misrepresent your location or device
• Attempt to manipulate the rewards system through fake completions, repeated cancellations, or coordinated multi-account activity
• Scrape, copy, or reproduce the Service or its content beyond fair use
• Reverse engineer, decompile, or disassemble any part of the Service
• Interfere with the Service's operation (denial-of-service attacks, attempting to gain unauthorized access, exploiting vulnerabilities)
• Use the Service to violate any applicable law or regulation
• Misrepresent your identity, country of residence, or eligibility

Fraud and account suspension

We monitor for fraud and abuse. If we reasonably believe your account has been used for fraudulent activity, multi-accounting, manipulation of the rewards program, or any breach of these Terms, we may, without prior notice:

• Suspend access to your account pending investigation
• Reverse fraudulent EW credits and any earnings derived from them
• Forfeit your unwithdrawn EW balance
• Decline pending withdrawal requests
• Terminate your account and bar you from creating future accounts
• Report the activity to law enforcement and to our partners

We will give you an opportunity to respond before forfeiture in most cases, but reserve the right to act immediately where delay would cause further harm.

Third-party advertising

The Service may display advertisements served by third-party advertising networks, including Google AdSense and similar partners. Clicking on an ad will take you to a third-party site over which we have no control. We do not endorse the products, services, or content of advertisers. Any transaction you enter into with an advertiser is between you and the advertiser. See our Privacy Policy for how advertising partners use your information.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• AI outputs will be accurate, complete, or fit for any particular purpose
• Defects in the Service will be corrected
• Any specific amount of EW or income will be earned through the rewards program or any other Service feature

Some jurisdictions do not allow the exclusion of implied warranties; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SRIRUNGRUANG VISAHAKIJ COMPANY LIMITED, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) USD 100.

Indemnification

You agree to indemnify and hold harmless SRIRUNGRUANG VISAHAKIJ COMPANY LIMITED, its affiliates, officers, employees, and partners from any claim, liability, loss, damage, or expense (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your misuse of the Service; (c) your violation of any law or the rights of a third party; or (d) any content you submit to or generate through the Service.

Termination

You may stop using the Service and request account deletion at any time by emailing support@earnway.shop. We may suspend or terminate your account at any time for breach of these Terms, suspected fraud, prolonged inactivity, or where required by law. On termination:

• Your access to the Service ends
• Unwithdrawn EW that you legitimately earned will be paid out to your registered withdrawal method, subject to the minimum threshold and our fraud rules
• EW forfeited under our fraud rules will not be paid out
• Sections that by their nature should survive termination (intellectual property, disclaimers, liability, indemnity, governing law) survive

Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will notify you by email or through a prominent notice on the Service before the change takes effect. Continuing to use the Service after the change means you accept the updated Terms. If you do not accept the changes, you may close your account.

Governing law and disputes

These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-law rules. Any dispute arising from or relating to these Terms or the Service will be brought exclusively in the courts of the Kingdom of Thailand, and you consent to the jurisdiction of those courts.

Before filing a formal claim, you agree to first contact us at support@earnway.shop and attempt in good faith to resolve the dispute informally for at least 30 days.

If you are a consumer protected by mandatory consumer-protection laws in your country of residence, those laws apply in addition to (and where they conflict, in priority over) the choice of law above.
